2. Acceptance of terms

Accessing and using www.purasangre.nl, as well as placing any order, constitutes the full and irrevocable acceptance of these Terms of Service (hereinafter 'ToS') as published at the time of purchase.

By confirming an order, the customer expressly declares: (a) being at least 18 years of age or having sufficient legal capacity to enter into contracts; (b) that the details provided are truthful, complete and up to date; (c) having read and accepted these ToS, the Privacy Policy, the Cookie Policy and the Returns Policy.

 

3. Products and availability

PuraSangre specialises in the import and sale of Spanish and European gourmet food products: cured meats and charcuterie, preserves, cheeses, olive oils, bakery products and other gourmet items. All products are subject to stock availability. If a product is unavailable after order confirmation, PuraSangre will contact the customer within 2 business days to offer a substitute, partial refund or full cancellation with complete refund.

 

4. Prices, VAT and invoicing

All prices are quoted in euros (€) and include applicable Dutch VAT (BTW), unless expressly stated otherwise. Shipping costs are not included in the product price and are calculated and displayed separately before order confirmation. PuraSangre reserves the right to modify prices at any time; already confirmed orders will not be affected.

 

⚠ Pricing errors If a product is published at a manifestly incorrect price due to a technical or human error, PuraSangre reserves the right to cancel the order and issue a full refund, without any further obligation or liability towards the customer.

 

5. Order process and contract formation

The purchase contract is formed at the moment PuraSangre sends the customer the order confirmation email. Until that moment, PuraSangre assumes no supply obligation and may reject or cancel any order for justified reasons (fraud, data error, out-of-stock, etc.).

 

6. Payment

Payment is processed securely through Shopify Payments, managed by Stripe (PCI-DSS Level 1 certified). PuraSangre accepts the payment methods enabled on its platform. PuraSangre does not store card data. No deferred payment, instalments or financing is offered. If payment cannot be processed, the order remains on hold for 48 hours; if unresolved, the order may be cancelled.

 

7. Shipping and delivery

Orders are prepared within up to 7 calendar days from confirmation. Shipments are handled through DHL with an automatic tracking number sent to the customer by email. Delivery times are indicative and non-binding. PuraSangre does not guarantee exact dates. Delays attributable to the carrier, customs or force majeure do not create liability for PuraSangre. 8. Order cancellation by the customer

The customer may request cancellation before the preparation phase begins (which may start as early as 24 hours after confirmation). Once preparation has started, PuraSangre may retain up to 15% of the order value to cover preparation and handling costs already incurred. Once the order has been handed to the carrier, it cannot be cancelled under any circumstances.

 

9. Returns and guarantees

As PuraSangre mainly sells perishable food products, the 14-day right of withdrawal does NOT apply to the majority of its products, pursuant to Article 16(d) and (e) of Directive 2011/83/EU. Returns are only accepted in the cases set out in the Returns Policy: product expired at delivery, incorrect product, transit damage or manufacturing defect. 10. Acceptable use of the platform

The following are expressly prohibited: unauthorised access to PuraSangre's systems; mass data extraction (scraping, crawling, bots); sending false, offensive or unlawful content through PuraSangre's channels; placing orders with false or unauthorised identity or payment details; any action that harms PuraSangre or third parties; and unauthorised resale of products where this infringes applicable regulations. PuraSangre reserves the right to cancel accounts and take legal action in the event of breach.

 

11. Minors

This store is intended exclusively for persons aged 18 or over. PuraSangre does not intentionally process personal data of users under 16 years of age, in accordance with the Dutch Uitvoeringswet AVG.

 

12. Intellectual property

All content on www.purasangre.nl (texts, images, logos, designs, source code, etc.) is the property of V.O.F. PuraSangre or its licensors, and is protected by Dutch and international intellectual and industrial property law. Any unauthorised reproduction, distribution or commercial use is expressly prohibited and may give rise to civil and/or criminal proceedings.

 

13. Liability and force majeure

PuraSangre is not liable for indirect damages, loss of profit or consequential losses. PuraSangre's maximum liability for any reason is limited to the total amount paid for the order in question. PuraSangre assumes no liability for non-performance due to force majeure (natural disasters, pandemics, strikes, cyber-attacks, government restrictions, etc.).

 

14. Business customers (B2B)

Customers purchasing products in the course of their professional activity do not benefit from the specific protections of consumer law. 15. Amendments to these terms

PuraSangre reserves the right to modify these ToS at any time. The version in force is always the one published at www.purasangre.nl with its date of last update. Continued use of the store after the publication of amendments constitutes acceptance thereof.

 

16. Governing law, jurisdiction and dispute resolution

These ToS are governed by Dutch law. Disputes not resolved amicably will be submitted to the competent courts of the Netherlands, without prejudice to the mandatory rights of EU consumers under the law of their country of residence.
